STOP WORK ORDER : RED TAG I was hired by a client that did not have all permits, the client was doing other work besides what the had pull permit for therefore the Inspector gave them a "STOP WORK ORDER". As a Licensed General Contractor we can pull a Master permit, have a  Plumber and Electrician pull their permits to continue with the work.

CHANGE OF CONTRACTOR: Not a problem again as a Licensed GC since the owner had many problems with Contractor we made a quick change of Contractor and continue with work at job site. Timing "for change of Contractor" depends on "The City" your work is getting done.

EXPIRED PERMITS: Now this can be a complicated issue, It depends if you need PLANS, IF YOU NEED A SURVEY AND what kind of permit needs to be "pulled". Again we can be of help.

CONSTRUCTION WITHOUT A PERMIT:  To legalize existing additions you will need PLANS, PERMITS and a STRUCTURAL ENGINEER to certify that all existing work is properly done. If it was done poorly, You will have to demolish it and you will need permit for demolition if you have any Electrical and/or Plumbing those permits by licensed contractors have to be pulled too.

MAKE SURE YOUR CONTRACTOR IS LICENSED AND INSURED !!! DO NOT HIRE UNLICENSED CONTRACTORS. YOU MAY HAVE TO PAY DOUBLE OR TRIPLE THE COSTS AND HAVE TO DEMOLISH WHAT YOU DONE, IF YOU GET CAUGHT BY THE CITY.

THE "MIAMI-DADE COUNTY" LICENSE HAS A PICTURE IN IT AND SPECIFIES WHAT "KIND OF CONTRACTOR" THE LICENSED HOLDER IS.

FOR EX. TILE CONTRACTOR, FLOORING CONTRACTOR, A/C CONTRACTOR, ELECTRICAL CONTRACTOR ETC. 

A TILE CONTRACTOR IS NOT LICENSED TO "REMODEL BATHROOMS" OR "KITCHENS" OR TO DO ADDITIONS THE SAME FOR OTHER CATEGORIES SUCH AS ELECTRICAL (just for wiring electrical, lighting). PLUMBING CONTRACTOR is just for PLUMBING ONLY.  A PLUMBING , ELECTRICAL, AND FLOORING CONTRACTORS ARE NOT QUALIFIED TO REMODEL BATHROOMS, KITCHENS ADDITIONS, ETC.

**ABOUT LICENSES**

1. A LICENSED CONTRACTOR MUST HAVE THE CARD LICENSE AT ALL TIMES, IN HIS WALLET AND SHOW IT TO YOU, IF YOU ASK FOR THE LICENSE CARD.

2. A FLORIDA "STATE LICENSE CARD" DO NOT HAVE PICTURES IN IT.

3. A  "MIAMI DADE COUNTY" LICENSE CARD DO HAVE A PICTURE IN IT.

***OWNER BUILDERS RISKS***

WHEN YOU PULL A "OWNER BUILDER'S PERMIT" YOU ARE THE "General Contractor" FOR THE PROJECT THEREFORE YOU ARE RESPONSIBLE FOR ALL WORK TO BE DONE, INSURANCES ETC. IF ANYBODY GETS HURT ON THE JOB, YOU ARE LIABLE. IF ANYBODY GETS HURT BECAUSE THE WORK WAS FAULTY, YOU ARE LIABLE.

Let me make it clear, when you are pulling permits; as an OWNER BUILDER you are responsible for the quality of work, passing all inspections, all building codes, insurances, and all people that comes into your property and other's people property (neighbors). Make sure that you have a GOOD "GENERAL LIABILITY INSURANCE".

 

You can complain to the building department DBPR if hired hands are "licensed" in the State Of Florida or Miami Dade County.

You can NOT complain to the DBPR if hired people are unlicensed.

****UNLICENSED CONTRACTORS****

1. Unlicensed contracting is generally charged as a first degree misdemeanor in the State of Florida, with penalties of up to 1 year in jail or 12 months of probation, and a $1,000.00 fine.

2. Unlicensed Contractors’ CONTRACTS are Unenforceable (NO TIENEN VALIDES). Pursuant to section 489.128, Fla. Stat., contracts entered into by an unlicensed contractor shall be unenforceable in law or in equity by the unlicensed contractor.

3. You may recover all fees paid to unlicensed contractors (consult a lawyer that specializes in "Construction Contracts").

CLARIFICATIONS FOR PEOPLE WHO HAVE NO KNOWLEDGE ABOUT REMODELING OR CONSTRUCTION LAWS IN FLORIDA

A Contractor should be a Licensed person to contract under his category

A "A" license: General contractor can build houses, buildings and commercial and residential remodeling.

A "B" license: Builder contractor can build houses, small buildings and remodeling.

A "C" license: Remodeling contractor just residential remodeling.
